Agreement to Terms

By accessing or using the Raen Fitness mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Raen Fitness ("we," "us," or "our").

Eligibility

  • You must be at least 13 years old to use the App
  • If you are between 13 and 17 years old, you must have parental or guardian consent
  • By using the App, you represent that you meet these age requirements

Health and Medical Disclaimer

NOT MEDICAL ADVICE

IMPORTANT: The App is designed for fitness and wellness purposes only. It is NOT a substitute for professional medical advice, diagnosis, or treatment.

  • Always consult a qualified healthcare provider before starting any new fitness program, especially if you:
    • Have any pre-existing medical conditions
    • Are pregnant or nursing
    • Are taking medications
    • Have a history of cardiovascular, respiratory, or musculoskeletal issues
    • Have not exercised regularly in the past 6 months
  • AI-generated workouts are based on general fitness principles and your self-reported information. They are NOT tailored medical prescriptions and should not be treated as such.
  • The App does not diagnose, treat, cure, or prevent any disease or medical condition
  • You assume all risks associated with using the App and following any workout programs, including but not limited to:
    • Physical injury
    • Muscle strain or soreness
    • Cardiovascular events
    • Exacerbation of existing conditions

Your Responsibility

  • Listen to your body: Stop immediately if you experience pain, dizziness, shortness of breath, or any discomfort
  • Use proper form: Follow exercise instructions carefully and use appropriate weights/resistance
  • Warm up and cool down: Always prepare your body for exercise and allow proper recovery
  • Stay hydrated: Drink adequate water before, during, and after workouts
  • Report issues: If you experience any adverse effects, stop using the App and consult a healthcare provider

Account Terms

Registration

  • You must provide accurate, current, and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • You are responsible for all activities that occur under your account

Account Security

  • Choose a strong, unique password
  • Do not share your account with others
  • We are not liable for any loss or damage from your failure to protect your account

Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Prolonged inactivity
  • Any reason we deem necessary to protect the App or other users

You may delete your account at any time by contacting us. Upon deletion, all your data will be permanently erased.

Acceptable Use Policy

You agree NOT to:

Prohibited Activities

  • Use the App for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the App's functionality or servers
  • Upload viruses, malware, or any harmful code
  • Reverse engineer, decompile, or disassemble the App
  • Use automated scripts, bots, or scrapers to access the App
  • Harvest or collect data from other users without their consent
  • Impersonate any person or entity

Content Standards

  • Do not upload offensive, abusive, or inappropriate images
  • Do not share content that violates intellectual property rights
  • Do not post content that is defamatory, hateful, or discriminatory
  • Do not use the AI Coach to generate harmful, illegal, or inappropriate content

We reserve the right to remove any content that violates these standards and take appropriate action against your account.

Intellectual Property

Our Ownership

The App, including all content, features, functionality, design, code, and trademarks, is owned by Raen Fitness and is protected by intellectual property laws. You may not:

  • Copy, modify, or create derivative works of the App
  • Sell, rent, lease, or sublicense the App
  • Remove or alter any copyright, trademark, or proprietary notices

Your Content

  • You retain ownership of data you input into the App (workout logs, profile information, uploaded images)
  • By using the App, you grant us a limited license to use your data to provide App services (e.g., generate workouts, display progress)
  • We do not claim ownership of your personal workout data

AI-Generated Content

  • Workouts generated by the App's AI are provided for your personal use
  • You may not sell, redistribute, or commercially exploit AI-generated workout plans
  • AI-generated avatars are for your personal profile picture use only

Third-Party Services

The App integrates with third-party services:

OpenAI

  • AI workout generation and chat features use OpenAI's API
  • Your data shared with OpenAI is subject to their Terms of Service and Privacy Policy
  • We are not responsible for OpenAI's data practices or service availability

Supabase

  • User data is stored on Supabase's infrastructure
  • Supabase's terms and privacy policy apply to data storage
  • We are not liable for Supabase service interruptions or data issues

Apple HealthKit (iOS only)

  • HealthKit integration requires your explicit permission
  • Apple's HealthKit terms and privacy policies apply
  • We are not responsible for HealthKit data accuracy or availability

PostHog (Analytics)

  • We use PostHog to collect anonymized usage analytics
  • Analytics help us understand feature usage and improve the app
  • Data is used solely for product improvement, not sold to third parties
  • PostHog's terms and privacy policy apply to analytics data

You agree to comply with all third-party terms when using these integrated services.

Subscription and Payments

Free Service

The App is currently provided free of charge. We reserve the right to introduce paid features, subscriptions, or in-app purchases in the future.

Future Paid Features

If we introduce paid features:

  • We will notify you in advance
  • You will not be charged without your explicit consent
  • Pricing, billing terms, and refund policies will be clearly disclosed
  • Payment processing may be handled by Apple (via In-App Purchases)

Disclaimers and Limitation of Liability

NO WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability or fitness for a particular purpose
  • Accuracy, reliability, or completeness of content
  • Uninterrupted or error-free operation
  • Security or freedom from viruses

We do not guarantee that:

  • The App will meet your fitness goals
  • AI-generated workouts are optimal for you
  • GPS tracking is 100% accurate
  • HealthKit sync will always work
  • The App will be available at all times

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

  • Any injuries, health issues, or medical conditions arising from using the App or following workouts
  • Direct, indirect, incidental, consequential, or punitive damages
  • Loss of data, profits, or business opportunities
  • Damages resulting from third-party services (OpenAI, Supabase, HealthKit)
  • Any damages exceeding $100 USD

Your Assumption of Risk

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:

  • Physical exercise involves inherent risks of injury
  • You are voluntarily participating in workouts at your own risk
  • You have consulted a healthcare provider if necessary
  • We are not liable for any injuries or health issues you experience

Indemnification

You agree to indemnify, defend, and hold harmless Raen Fitness, its owners, employees, and affiliates from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any injuries or damages you sustain while using the App

GPS and Location Data

  • GPS tracking is only activated when you start a cardio workout
  • Location data is used solely to map your workout route
  • GPS accuracy depends on your device, weather, and environmental factors
  • We are not liable for inaccurate GPS data or routing errors
  • Always use common sense and be aware of your surroundings when exercising outdoors

Data Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your data.

Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

  • We will update the "Last Updated" date
  • We will notify you via in-app notification or email
  • Continued use of the App after changes constitutes acceptance

If you do not agree to the updated Terms, you must stop using the App and may delete your account.

Termination

By You

You may stop using the App at any time and request account deletion by contacting us.

By Us

We may terminate or suspend your access immediately, without notice, for:

  • Breach of these Terms
  • Suspected fraudulent or illegal activity
  • Extended periods of inactivity
  • Any reason we determine necessary

Upon termination:

  • Your right to use the App ceases immediately
  • We may delete your account and data
  • Sections of these Terms that should survive (liability disclaimers, indemnification) remain in effect

Governing Law and Dispute Resolution

Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

Dispute Resolution

  • Informal Resolution: Before filing any legal claim, you agree to contact us and attempt to resolve the dispute informally
  • Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration, not in court
  • Class Action Waiver: You agree to resolve disputes individually, not as part of a class action or collective lawsuit
  • Small Claims: You may bring claims in small claims court if they qualify

Exceptions

The following are exempt from arbitration:

  • Claims related to intellectual property infringement
  • Requests for injunctive relief

Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Raen Fitness regarding the App.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full effect.

Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control (natural disasters, internet outages, third-party service failures, etc.).

No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.

Acknowledgment

BY CREATING AN ACCOUNT AND USING THE APP, YOU ACKNOWLEDGE THAT:

  1. You have read and understood these Terms of Service
  2. You agree to be bound by these Terms
  3. You understand the health and medical disclaimers
  4. You assume all risks associated with using the App and exercising
  5. You have consulted a healthcare provider if necessary
